FAQs
What is medical negligence?
Medical negligence is when healthcare professionals make errors or fail to uphold their duty of care, resulting in injury or worsening an existing condition.
This can happen in various ways, including misdiagnosis, improper treatment, or surgical errors.
Will it cost me to claim?
No, making a medical negligence claim with us is free. All our medical negligence claims operate on a no win, no fee basis.
This means if your claim is unsuccessful you don’t pay a penny. If your claim is successful, our costs are recovered from the negligent party and we will take a small ‘success fee’ from your compensation.
All of the above will be discussed and agreed with you before any paperwork is completed.
Are there time limits for claiming?
Yes, you have 3 years from finding out you have received negligent treatment. However, there are exceptions:
- Children – Claims can be made anytime before the child turns 18, once they become an adult, the 3-year rule comes into effect.
- Mental Capacity – If someone cannot claim for themselves then they have no time limit.
How long is the claim process?
This depends on multiple factors such as the severity of your injury and whether the negligent party accepts fault.
While we aim to settle your claim within a few months, more complex cases can take up to a couple of years to settle.
